Type B Work Permit. For company board members.

Zezwolenie typ B is a work permit for a foreigner serving on the management board of a Polish company: board member, president of the board (prezes), proxy (prokurent), or general partner. Analysing the company's eligibility

The key requirement applies to the company, not to you. The company must either (option 1) have achieved, in the previous tax year, income of at least 12 times the average monthly wage in the voivodeship and employ at least 2 workers not subject to the work-permit requirement on a permanent, full-time contract for at least a year; or (option 2) demonstrate the means and actions to meet these conditions in future — investment, job creation, innovation.

Preparing the company's documents

The company agreement (for a spółka w organizacji), the CIT return for the previous year, employment-status documents, the KRS, and proof of the board role. We prepare the full package.

Filing with the voivode

The application is filed by the company (the employer), not by you personally. Fee of 400 PLN. Review time — from 30 days, up to 6 months in complex cases. We monitor the process.

Link to a basis of stay

A Type B work permit is not legal residence. In parallel, we help arrange a visa or karta pobytu so you can lawfully stay in Poland and perform your role.

How does Type B differ from a standard work permit (Type A)?

Type A is for a foreigner working under a contract with a Polish employer in an ordinary role. Type B is for a foreigner performing a function on a company's board (board member, president, proxy, general partner). The conditions and documents for Type B are more demanding: the company's financial standing is assessed, not just the position.

Who doesn't need Type B?

If you're a board member but receive remuneration solely on the basis of a shareholders' resolution (uchwała wspólników), without an umowa o pracę or other civil-law contract — you don't need a Type B permit. It's also unnecessary if you spend less than 6 months in total in Poland over 12. We verify this precisely at the consultation.

What conditions must the company meet?

The company must either (1) have achieved, in the previous tax year, income of at least 12 times the average monthly wage in the voivodeship and employ at least two workers on a permanent, full-time contract for at least a year, or (2) demonstrate the means or actions to meet these conditions in future — investment, technology transfer, job creation. The second route suits young companies, but the permit is then issued for up to 24 months.

For how long is the permit issued?

Up to 3 years, with the option to renew. If the company employs more than 25 people at the time of filing — the voivode may issue the permit for up to 5 years.

Does Type B grant the right to stay in Poland?

No. A work permit is not the same as legal residence. You also need a visa or residence title (visa, karta pobytu) in parallel. We help arrange both, so there's no gap.

What's the risk if a board member works without Type B?

Working without the required permit is illegal: a fine for both the foreigner and the company (up to 30,000 PLN), and possible deportation. The company is obliged to secure a permit for all its foreign board members within 6 months of their appointment.
